  What can I do if I get a letter or phone call saying that a Bailiff is coming to my premises.

Contact us immediately, it is as simple as that. We have years of experience in dealing with this very situation and will be able to get this under control quite quickly. If you are an existing client, this may have occurred with a debt which is not on the debt management plan, contact us as soon as possible so we can review your financial statement and get the debt under control and an offer of repayment made straight away. If you are not one of our clients, contact us as soon as possible on 0800 027 9595 and we will contact the bailiff with an offer of repayment based on your income and expenditure.

If a bailiff turns up at your door, you do not have to let him in as they have no right to access your property without your permission. If you are not in at the time of their visit and you have left a window or door open, they do have the right of entry. If you have refused to talk to them, please contact us straight away so we can discuss this with the bailiff and get the debt under control, as they will return.

  What do I do if the bailiff is at my door

The bailiff can call at your house at any reasonable time to seize goods, but you do not have to let them in. The bailiff cannot enter your property by force, but they can legally enter your property through open windows or unlocked doors. Once the bailiff has been inside your house by entering peacefully, they can call again another day and enter your house without your permission, forcefully, to remove goods.

  What goods can they take from my property

A bailiff acting on a County Court Judgment cannot seize clothing, bedding, furniture, household equipment or other goods necessary to meet basic domestic needs. Generally, no bailiff can seize tools, books, vehicles or other equipment necessary for personal use in employment or business.  No bailiff can seize goods belonging to anyone other than the person named on the distress warrant. A bailiff cannot seize goods subject to a hire purchase or rental agreement (goods on credit sale can be seized because they belong to the person).  

Goods you own jointly with someone else can be taken.

  Your Rights

You cannot be sent to prison for not co-operating with a bailiff. You do not have to let them into your house. You should contact us as soon as possible on 0800 027 9595.
